Subject: Request for urgent review of single-sex accommodation and workplace policies
Dear Chief Executive Officer,
I am writing to request urgent clarification and review of your Trust’s policies relating to single-sex accommodation and staff facilities.
One year on from the Supreme Court judgment in For Women Scotland Ltd v The Scottish Ministers, the findings of a nationwide grassroots audit were published on 16 April via an interactive public map, which sets out the current status of NHS Trust policies on single-sex spaces here: https://seeninhealth.org/nhs-foi-map/. The findings show that NHS organisations do not provide protected single-sex facilities for patients or staff.
Common positions identified include:
- Accommodation based on gender identity or presentation rather than sex
- Staff access to changing rooms and toilets based on self-identification
- Policies that prioritise one group’s preferences over the rights of others
These raise concerns regarding compliance with:
- The Equality Act 2010
- Workplace regulations requiring suitable separate facilities for men and women
- NHS commitments to dignity, privacy and safety
Recent April 2026 Freedom of Information responses confirm policies remain “under review”, with organisations awaiting EHRC guidance demonstrating no change and that single-sex spaces are still not protected. I would be grateful if you could confirm:
- Whether your Trust has conducted a full review of all relevant policies following the Supreme Court judgment
- Whether your Trust currently provides clearly defined single-sex spaces based on biological sex, please provide examples.
- If you are awaiting national guidance, what interim measures are in place pending updated national guidance
- When updated, legally compliant policies will be published
I also ask that your Trust ensures transparency by making all relevant policies easily accessible to the public.
This is an issue of significant public interest, and it is essential that Trusts act promptly to ensure both legal compliance and the protection of all patients and staff.
